Director - Global Sourcing & Data Privacy - Bank of America Merrill Lynch - Hong Kong


Job description
The successful candidate will be invited to join Bank of America’s Legal Department as a member of the Global Sourcing Legal Team. The candidate’s primary responsibility will be to provide APAC regional legal support to Bank of America’s Global Sourcing function, which is responsible for the strategic sourcing of products and services from third party vendors. In addition to supporting Global Sourcing, the candidate will also partner with the Enterprise Privacy Legal Team to provide APAC regional legal advice on data privacy issues.

RESPONSIBILITIES
The successful candidate will support the structuring, drafting, and negotiation of complex, regional vendor agreements. The role will require the candidate to work directly with Bank of America Lines of Business to address their requirements while simultaneously ensuring compliance with all applicable internal policies, laws, and regulations. The candidate will have primary responsibility for high risk vendor transactions and will act as an escalation point and support partner for the Global Sourcing team on low risk vendor transactions. The candidate will also provide Global Sourcing with general legal support on such matters as program and template development, regulatory compliance, remediation of pre-existing vendor issues, and the resolution of vendor disputes.
In addition to the aforementioned Global Sourcing responsibilities, the successful candidate will also partner with the Enterprise Privacy Legal Team to provide legal advice to Bank of America’s Enterprise Privacy Compliance function in connection with the assessment of evolving APAC data privacy legislation, the preparation of internal and external privacy related policies and communications, and responding to data privacy breach incidents, access requests, and privacy related complaints.

The role will require close partnership with other Bank of America internal functions such as Compliance, Operational Risk, Vendor Management, and Finance. The successful candidate will also need to engage and manage outside counsel from time to time. The candidate will have sole coverage responsibility for the APAC region for Global Sourcing Legal and will be required to demonstrate a high degree of autonomy in a demanding and fast-paced environment. The candidate will also have coverage responsibility for APAC Data Privacy matters. The ability to manage clients and to coordinate with support partners across different jurisdictions and in multiple time zones will be essential. Although the role focuses on the APAC region, the candidate will also have the opportunity to interact with other regions through participation in global vendor transactions and Vendor Management/Data Privacy projects.

Desired Skills and Experience

US or commonwealth qualified with a minimum of 7 years PQE in an international law firm or multinational corporation.
Strong track record of negotiating complex, high value commercial contracts with emphasis on purchasing/sales, licensing, general service, telecommunication, and outsourcing agreements. Familiarity with technology and intellectual property issues would be an asset.
Broad knowledge of APAC data privacy laws and regulations.
Ability to manage responsibilities across multiple jurisdictions and time zones and manage a high volume of work and clients in a fast-paced environment.
Ability to communicate clearly, both verbally and in writing, and to adapt quickly and be quick learner.
Fluency in spoken and written English is essential. Japanese and/or Mandarin language skills desirable but not required.
